The delay of 192 days are condoned. The application stands disposed of.
ORDER
1. The petitioner has challenged the impugned order dated 09.11.2010, whereby the learned revision court has imposed a cost of Rs.10,000/- upon the revisionist granting one more opportunity to him for examination of the witness i.e handwriting expert. It was observed by the learned revision court as under " The court was quite lenient to t/?e accused while giving opportunity of leading the defence evidence. The leniency is appears to be misused by the accused by delaying the matter". 2011:DHC:11514.0- 2_.
2. The learned counsel for the appellant requests that the appellant is a poor person and working as a Driver and the cost innposed upon him is very high and it may be waived of.
3. Keeping in view the facts and circumstances of the case as well as the financial condition of the appellant, the impugned order is modified to the extent of cost which is reduced to Rs.5,000/- to be payable by the petitioner in terms of impugned order.
4. Criminal |V|.C. 2457/2011 is partially allowed on the above terms. CRL. M.A. 8855/2011(stav) The application is disposed of being in fructuous.
