Learned counsel for the petitioner submits that the matter is fixed for hearing before the learned Trial judge on 02nd August, 2011 and the petitioner shall put in appearance in that court on the date fixed and move appropriate application, seeking cancellation of proclamation order issued against him. In the meanwhile, he requests for protection against the arrest Learned counsel undertakes, on instructions of the petitioner, that petitioner shall appear in the Trial Court tomorrow.
In view of the above, it is ordered that the petitioner shall appear before the Trial Court on 02nd August, 2011 and his application, if any moved, shall be decided by the Trial Court in accordance with the law.
Learned counsel for the petitioner, in view of the aforesaid order, seeks to withdraw the main petition.
Main petition bearing CrI.M.C. 1993/2011 is dismissed as withdrawn.
Petitioner shall remain bound by his undertaking.
