The compliance affidavit of the respondent states that the order and directions of this court upholding the order passed by
Central Administrative Tribunal dated 03.12.2007 has been complied with in true letter and spirit.
It is submitted that the case of the petitioner was considered for 3 DPCs; he was found ineligible in all the three DPCs; the DPC for the year 2008 had been held on 05.09.2008 i.e. after the date of retirement of the petitioner which was on 31.08.2008.
Recommendation had in fact been made on 31.10.2008; name of the petitioner had been considered for promotion and all financial benefits had been accorded to the petitioner with effect from
31.08.2008.
In this view of the matter, nothing survives in this petition.
Petition is disposed of.
