We have heard Counsel for the parties. The impugned
Order has struck off the defence of the Appellant for the failure to deposit Costs of t 50,000/-. A sum of { 35,000/- stands deposited by the Appellant with the Registry. The Registry is directed to disburse this sum to learned Counsel for Respondents No. L to 6 forthwith. Mr
A.K.Singh learned Counsel for the Appellant submits that the cheque for
December, 20L0, which has not been encashed shall be revalidated immediately.
Subject to the cheque being revalidated within one week from today, the impugned order, inasmuch as it strikes off the defence of the Appellant shail stand recalled.
Appeal stands disposed of.
