Present: Mr.Pankaj Dwivedi, Advocate for the petitioner.

Affidavit has not been filed in terms of the last order. On the last date, the Court had imposed a cost of ?30,000/- for setting aside the ex-parte order which had been passed against the defendant. Learned counsel for the petitioner seeks reduction in the amount of cost. Learned counsel for the petitioner was present on the date when the order was passed. This was on 11.02.2011; five months have elapsed since then. No variation is called for in the order. Since the order dated 11.02.2011 has not been complied with and also the fact that the petitioner has not even made a statement to the Court that he is willing to comply with the said order, orders dated 24.11.2010 and 06.01.2011 stand revived.
Petition disposed of.
A copy of this order be sent to the trial Count for information.
