JUDGMENT
1. A guardianship petition has been filed by the respondent herein and during the pendency of the above said petition, on the basis of one application moved by him and with the consent of the parties, the learned Trial Court vide order dated 9th October, 2024 directed that the mother of the child would bring the minor child on 19th October, 2024 at 3:30 P.M. in Children’s Room situated at Tis Hazari Courts, so that the child can meet his father and grandparents.
2. Earlier, the visitation was fixed for 7th October, 2024 but it was changed to 19th October, 2024.
3. The short submission made before this Court is that the child is unwell and, therefore, the date may be suitably changed so that the visitation takes CM(M) 3644/2024 2 place when the child is relatively better.
4. Ideally, the application for modification should have been made before the learned Family Court itself.
5. Learned counsel for the respondent is present with respondent and though, according to them, the child should be very much alright, they would have no objection if the date is suitably modified.
6. Accordingly, keeping in mind the above and fact that the visitation is otherwise scheduled for tomorrow only, the petition is disposed of directing that while the other terms and conditions as specified in order dated 9th October, 2024 would remain the same, the visitation shall take place on 8th November, 2024, instead of on 19th October, 2024.
7. Since no other relief is being sought, the petition stands disposed of in the aforesaid terms.
