Present: Mr. Deepak Arora, Advocate for the petitioner. jvis. Jasbir Kaur, APP for the respondent No.1/State.
+Crl.M.A.No.9154/2011
Exemption allowed, subject to all just exceptions.
Application stands disposed of.
Bail Appln. 1081/2011
This is a petition seeking anticipatory bail in case FIR No. 286/2005 under Sections 406/420 IPG, P.S. Rajouri Garden.
It is submitted on behalf of the petitioner that parties have already settled the matter in the year 2007 and now, there is no dispute left.
Thus, learned counsel has urged for grant for anticipatory bail to the petitioner.
Learned APP appearing for the State opposes the prayer for grant of anticipatory bail.
Perusal of record would show that the FIR against the petitioner has filed under Sections 406/420 IPG. I have been informed that charge sheet has already been filed and learned counsel for the petitioner states that the petitioner has been declared Proclaimed Offender. If at all, the parties have settled the matter and the offences being compoundable, the petitioner could easily have moved the Trial Gourt along with the complainant for compounding of the offences. Therefore, considering the fact that the petitioner has been declared Proclaimed Offender, I do not find it appropriate to admit the petitioner on anticipatory bail.
Application is dismissed.
