CORAM:
HON'BLE MR. JUSTICE MANMOHAN
26.08.2011 The present petition has been filed under Section 560 of the
Companies Act, 1956 for restoration of petitioner-company. it Mr. K.S. Pradhan, Deputy Registrar of Companies appearing for respondent states that he has no objection to the name of the petitioner- company being restored provided petitioner-company files all pending statutory returns, i.e., Annual Returns and Balance Sheets and pays additional fee as prescribed under law.
2011:DHC:7586 Keeping in view the fact that the Annual Returns and Balance Sheets have not been filed by the petitioner-company for a period of nearly ten years, Mr. Satinder Singh Bawa, learned counsel for petitioner-company himself states that petitioner-company would pay additional costs of
Rs. 1,00,000/- to respondent.
Accordingly, upon payment of costs of Rs. 1,00,000/- within a period of three weeks, the name of the petitioner-company shall stand restored and its status would be changed from inactive to active company. Petitioner- company is granted four weeks' time to file all the statutory documents i.e., annual returns from 30.09.2000 to 30.09.2010 and balance sheets as at
31.03.2000 to 31.03.2010 as applicable as on the date of actual filing date through system with additional fee as prescribed under the Companies Act, 1956.
With the aforesaid observations, present petition stands disposed of.
