19.08.2011 The present petition has been filed under Section 560 of
Companies Act, 1956 for restoration of petitioner-company.
Mr. Atma Sah, Assistant Registrar of Companies appearing for
0 . respondent states that he has. no objection to the name of the petitioner-company being restored provided petitioner-company files all pending statutory returns, i.e., Annual Returns and Balance Sheetsl and pays additional fee as prescribed under law.
Keeping in view the fact that the Annual Returns and Balance
Sheets have not been filed by the petitioner-company for a period of
2011:DHC:7559 -J nearly four years, Mr. Prabhjit Jauhar, learned counsel for petitioner- company himself states that petitioner-company would pay additional costs of Rs. 1,00,000/- to respondent.
Accordingly, upon payment of costs of Rs. 1,00,000/- withiii a period of three weeks, the name of the petitioner-company shall stahd restored and its status would be changed from inactive to active company. Petitioner-company is granted four weeks' time to the
• Annual Returns of 30th September, 2000 and
30th September, 2007 Ito 30th September, 2010 and Balance Sheet as at 31St March, 2000 and
31St March, 2007 to 31St March, 2010, Return of Allotment of shars in prescribed Form No.2 since 13th December, 2000 and Form 32 in respect of Ms. Bharti Rawla with filing fees and additional fee as applicable as on the date of actual filing.
With the aforesaid observations, present petition and application stand disposed of.
