This is the second application for modification. The prayer of the

12.08.2013 t Crl. M.A. 12030/2013 (for modification)
L This is an application for modification of order dated 19^*^
December, 2012 for releasing the petitioner on furnishing personal bond along with deposit of cash surety in lieu of surety bond on the ground that the petitioner is not in a position to furnish the surety and he has been still languishing in jail despite granting parole.
ORDER

2. The application is opposed by learned additional standing counsel on the ground that the petitioner is convicted for offence under Sections 302/394/34 IPC and in case he is released on personal bond without surety there is every likelihood of his non availability afterhe is released on parole. Moreover, the petitioner is stated to be.A \'S resident of Uttranchal, that being so, the local police will have no control over him, therefore, the prayer is opposed.

3. Record reveals that the petitioner was ordered to be released on parole, on furnishing of personal bond in the sum of Rs.25,000/with two sureties in the like amount. On his request, the surety was reduced to one. On his further request, the order was modified to the If. extent that he be released on furnishing surety bond in the sum of Rs. 15,000/- and thereafter to Rs.5,000/- but he did not furnish the same. However, keeping in view the seriousness and gravity of the offence for which the petitioner has been convicted, it will not be desirable to release him on personal bond with cash surety as prayed for.

4. As such, the application is dismissed.
