CORAM:
HON'BLE MS. JUSTICE MUKTA GUPTA

Crl.
M.A. No. 10296/2011 (Exemption)
Allowed, subject to all just exceptions. w.P. (crl.) No. 1206/2011 & Crl.
M.A. No. 10295/2011 (StaY)
By this petition the Petitioner seeks quashing of FIR No. 156/2009 under Sections 406 IPC registered at PS Economic Offence Wing, Delhi on the complaint of the Respondent No.2. w.P.(cRL) 1206/2011 Page I of 3 o/o
2011:DHC:16969 u
The allegations as set out in the FIR are that Complainant entered into an agreement to sell with regard to the third floor and tqrraqe rights over the third floor of properfy B-20, Maharani Bagh, New Delhi. HoweVer, thereafter the Petitioner delayed in handing over the possession and executing the sale deed.
Learned proxy counsel for the learned Additional Standing Counsel for the State on instructions.from Inspector Ajuy Kumar, PS Economic
Offences Wing says that in the FIR case no other victim is involved except
Respondent No. 2.
The Respondent No. 2 who is present in person and is identified by his counsel states that the Petitioner and Respondent No.2/Complainant have settled the matter and he has been given the vacant peaceful possession of the properfy in question. Further the sale deed has also been executed between the parties. He fuither states that in view of the settlement arrived at between the pafties, he does not want to pursue the abovementioned FIR and the proceedings pursuant thereto.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful putpose will be served in continuance of the proceedings, rather the w.P.(cRL) 1206/2011 z same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.
Consequently, FIR No. 1 5612009 under Sections 406 IPC registered at
PS Economic Offence Wing, Delhi and proceedings pursuant thereto are hereby quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
The petition and the pending application are disposed of. Order dasti.
