This revision petition has been filed against an interlocutory order passed by the trial Court whereby it has declined to stay the probate case filed by the respondents herein during the pendency of the partition suit filed by the petitioner herein. Even if the order had been passed in favour of the petitioner - defendant it would not have disposed of the suit since the application moved by the petitioner was under Section 10 CPC only for stay of the probate case and so, I am not inclined to entertain this revision petition.
The same is accordingly dismissed without going into the merits of the case.
