This is a petition for quashing of FIR No. 29112007 under Sections
4}BN406134IPC registered at PS Kingsway CampAvlodel Town, Delhi.
The Complainant/Respondent No. 2 Ms. Shabnam is present in person and is identified by her counsel. She states that the Petitioner and Respondent
No.2/Complainant have entered into a Compromise through mediation. It is fuither stated that the divorce between the parties has already been effected. As full and final settlement of all the claims of the Respondent No. 2, the
Petitioner has paid T75,000/-. She also states that the as per settlement the children wiit be in the custody of Respondent No. 2. She further states that in w.P.(cRL) 12ss/2011 Page I of 2
2011:DHC:17069 view of the settlement between the parties, she does not want to pursue the abovementioned FIR and the proceedings pursuant thereto.
In the present FIR the family members of the Petitioner were put in
ColumnNo. 2 and only the Petitioner was swnmoned. Thus the case before the learned Trial Court is proceeding only against the Petitioner.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.
Consequently, FIR No. 29112007 under Sections 498N406134 IPC registered at PS Kingsway CampAvlodel Town, Delhi and proceedings pursuant thereto are herebY quashed. parties have signed this order sheet in acknowledgment of their statements made before this Court.
The petition is disposed of. Order dasti.
