ORDER
2. Learned counsel for petitioners submits that on the complaint of respondent No.2, case FIR No.379/2007 under Section 498A/406/34 Indian Penal Code was registered against the petitioners at police station Mandwali Fazalpur, Delhi. Pursuant to the settlement dated 05.04.2011, petitioner No.1 and respondent No.2 are staying together as husband and wife. CRL.M.C. 2876/2011 Page 1 of[3] '.;: ~ I ~,--, '.. '.. 3. Respondent No.2/Smt.Anshu Gup~present in person, who has been duly identified by learned counsel for the petitioner, in addition, she has also produced her original voter identity card issued by Election Commission of India bearing No.BQF1455690 issued in her name as Anshu d/o Shri Raj Kumar Gupta and photocopy thereof has been placed at page No.64 of the petition. Original seen and returned to respondent No.2.
4. Further submitted that matter has been reconciled and respondent No.2 has joined her matrimonial house and is living happily with petitioner No.1. In view of such reconciliation, respondent submits that she has no objection, if the present FIR is quashed against the petitioners.
5. Keeping the settlement into view and the fact that respondent No.2 has joined her matrimonial house and living happily. Therefore, in the interest of justice, FIR No.379/2007 under Section 498A/406/34 Indian Penal Code registered against the petitioners at police station Mandwali Fazalpur, CRL.M.C. 2876/2011 Page 2 of[3] ' ' ' -,-·! _,_,, ~~j !;: li: w I -~-- Delhi and the proceedings arising the~m are hereby quashed.
6. Since the matter has been reconciled, I defer in imposing any costs upon the petitioners.
7. In view of above, Criminal MC No.2876/2011 is hereby allowed and disposed of accordingly.
