JUDGMENT
1. Learned counsel for the appellant does not press the appeal but states that it should be without prejudice to the rights of the appellant/plaintiff to pursue the suit and claims the reliefs therein.
2. lt is clarified that nothing contained in the impugned order will, in any manner, prejudice either of the parties at the stage of the final judgment and the suit will be disposed of by the Trial Court after trial in accordance with law. The appeal is dismissed as not pressed.
