ORDER o/o L2,O9,2OLL It is pointed out to the learned counsel for the petitioner that as per the arbitration agreement the authority empowered to nominate the Arbitrator is the Chief Engineer (DA), Zone-ll on behalf of Lt.
Governor of the Union Territory of Delhi, however, the notice of invocation has been addressed to the Govt. of National Capital
Territory of Delhi through Chief Secretary.
Learned counsel for the petitioner wishes to withdraw this petition with liberty to address a fresh notice to the Chief Engineer
(DA), Zone-ll for invocation of arbitration agreement and, if necessary, thereafter file a fresh Petition.
Dismissed as withdrawn with liberty as prayed for.
