CORAM:
HON',BLE MR. JUSTICE VIPIN SANGHI..... Respondent
16.09.2011 It has been pointed out to the learned counsel for the petitioner that the arbitration agreement between the parties is contained in
Clause 26 and the agreement provides for conduct of arbitration by a named Arbitrator, namely Sh. Rakesh Batra, R/o A-15, New Friends
Colony, New Delhi-65. The petitioner, it appears, has not invoked the arbitration agreement by seeking reference of disputes to the named
Arbitrator.
Learned counsel for the petitioner wishes to, therefore, withdraw this petition with liberty to invoke the arbitration agreement by calling upon Sh. Rakesh Batra to adjudicate the petitioner's claims.
Dismissed as withdrawn with liberty as prayed for.
