* This is the umpteenth time that the petitioners had to approach this Court on account of the conduct of the respondents in making every endeavour to ensure that tenders are not awarded to petitioner No. 1 despite petitioner No. 1 being L-1.
We would have imposed exemplary costs on the respondents, but for the fact that learned counsel for the respondents on instructions from Mr. A.K. Gupta, Executive
Engineer, MCD (present in Court) states that tender No. 132887 dated 19.07.2011, where petitioner No. 1 is L-1, will be processed and awarded to petitioner No. 1 within a maximum period of four weeks from today. Mr. Gupta undertakes to this Court to do the needful and he is made conscious and aware of the consequences of violation of the undertaking to the Court.
The writ petition and the application stand disposed of in the aforesaid terms.
