Learned counsel for the petitioner has pointed out that the second notification dated 14.04.1979 which is subsequent to the first notification dated 23.05.1963 has since been pubhshed in the
Gazette of India; contention is that knowledge of this notification was not known to the petitioner at the time when the impugned order was passed.
After some arguments, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty granted to him to approach the concerned Court informing him of the second notification dated 14.04.1979; the concerned Court shall examine the said notification and its applicability to the present case.
With these directions, this petition is disposed of.
