ORDER
1. The grievance of all the petitioners is that the documents presented by them for registration to the respondent No.1 Sub-Registrar, Sub-District-Vl- C, Rohini, Delhi as far back as in the year 2007 have not been returned with the endorsement of registration inspite of repeated requests and reminders of the petitioners.
2. The petitioners rely upon the counter affidavit filed in w.P.(c) No.1062/2011 filed by one Smt. Sarika with similar grievance. It is stated in the said counter affidavit that an inspection of the office of the Subproceedings contemplated and the Sub-Registrar placed under suspension; the documents submitted for registration are subject matter of the said proceedings against the then Sub-Registrar and as such could not be released.
3. The refusal of the Sub-Registrar to register the documents within the prescribed time, under Section 72 of the Registration Act, 1908 is appealable before the Registrar. The Registrar besides being the Appellate Authority is also the Administrative Head of the Sub-Registrars. It has as such been enquired from the counsel for the petitioners as to how the present petitions are maintainable in the face of the availability of alternative remedy. I I I t
