JUDGMENT
1. Learned counsel for the respondent/Bank has fairly conceded that the matter has been settled with the petitioner and within a period of one week from today, the Settlement Letter will be issued to the petitioner.
2. Mr.Goel, learned senior counsel has also stated that the setuement has been arrived at with the respondent/Bank and in pursuance to the settlement, an amount of Rs.75 lacs has already been paid by the petitioner to the respondent/Bank, which has been duly acknowledged by them. Therefore, it is contended that in the light of the submissions made by learned counsel for the respondent/Bank, at the bar, that they will issue an appropriate letter to the petitioner within a period of one week, the petitioner does not press the present i*' 2011:DHC:12265 I petition. However, it is urged by him since the matter is coming up before the learned Metropolitan Magistrate on L[6].9.2011, the parties may be exempted from their personal appearance.
3. In the light of the submissions made by the learned senior counsel for the petitioner as well as the learned counsel for the respondent/Bank, the petition is dismissed as withdrawn with direction to the learned Trial Court to adjourn the matter for four weeks so as to ' tv enable the parties to arrive at a final resolution of the matter.
