JUDGMENT

1. Allowed, subject to all just exceptions.

2. This petition has been filed by the petitioner praying for the following reliefs: “a. Issuance of a writ in the nature of mandamus or any such order by directing the Respondent No. 2 to 5 for calling the basic pay fixation record of the Petitioner Insp/GD Ramji Lal Force No. 831190601 from the joining to till date in order to rectify the basic pay scale of the Petitioner in interest of justice, b. To issue a writ of mandamus or any such order by directing the Respondent No. 2 to 5 to re-fix/correct the pension of the Petitioner similar to that of his similarly placed personnel; c. To issue the writ of mandamus or any such order directing the Respondent No. 2 to 5 to grant the remaining HRA amount since the duration of 2019 2023. d. To issue the writ of mandamus or any such order directing the Respondent No. 2 to 5 to grant all the subsequent benefits arising therefrom to the petitioner and the respective arrears after re-fixation of his basic pay scale be granted to the petitioner along with his pension.”

As far as prayers ‘a’ and ‘b’ are concerned, the learned counsel for the respondents, who appears on an advance notice, submits that by an Order dated 14.10.2022 passed by the Assistant Commandant/Minister (Central)-2 Group Centre, Central Reserve Police Force (CRPF), Sonipat, Haryana, the representation of the petitioner has been decided and his basic pay has been re-fixed with effect from 2013.

4. He submits that as far as the prayer ‘c’ is concerned, the present petition will be considered as a representation and the same will be decided by the respondents within eight weeks from today, communicating the decision to the petitioner.

5. The respondents are directed to do so.

6. In case the petitioner is aggrieved of the Order dated 14.10.2022, or any other order which shall now be passed by the respondents on the representation with respect to the HRA, it shall be open to the petitioner to challenge the same in accordance with law.

7. The petition is disposed of in the above terms.
