The complainant/Petitioner Ms. Aekta Jerath who is present in person and is identified by her counsel states that she has settled the matter. In terms of the settlement the statement under first motion for divorce by mutual consent has already been recorded. She has received a sum of Rs. 25 lakhs till today including Rs. 7 lakhs paid to her today in Court. She states
CRL.M.C. 296612011 2011:DHC:12931 that Respondent No. 2 & 3 have agreed to pay a further sum of Rs. 25 lakhs at the time of recording of statement for second motion. She states that she has no objection if the abovementioned FIR and the proceedings pursuant thereto are quashed in view of the settlement arrived at between the parties.
Respondent No.2 & 3 who are present in Court and are identified by the Investigating Officer state that they have entered into a settlement with the Petitioner. In terms of the settlement, it has been agreed between the parties that a divorce by mutual consent would be obtained. They have already paid a sum of Rs. 25 lakhs and they will pay the balance amount of
Rs. 25 lakkis at the time of recording of the statement of second motion for divorce.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovernentioned FIR and the proceedings pursuant thereto.
