The order impugned before this Court is the order dated
29.11.2010 vide which the apphcation filed under Section 5 of the
Limitation Act seeking condonation of delay in filing the appeal; i.e. the delay of 33 days was condoned. The Court had exercised its
/ discretion and condoned the delay of 33 days; record shows that the respondent (petitioner herein) was also present at that time.
The impugned order suffers from no infirmity. ;^iscretion was exercised fairly. Dismissed.
