Mr. Gaurav Khanna, pro4y counsel for the petitioner seeks an adjournment on the ground the Mr. Rajat Rai Durga, the main counsel, is in some personal difficulty.
Mr. H.S. Kohli, proxy counsel for respondent no.2, on the other hand, has apprised this Court that an award in respect of which the petitioner is seeking enforcement through the present writ petition is already under challenge before this
Court in WP(C) No.7667 /1999 wherein the operation of the award was stayed vide order dated 22.L2.2009. Counsel also submits that the petitioner is also contesting the said writ petition filed by respondent no.Z.
Once the operation of the same has been stayed in
W.P.(C) No. 76671t999, then certainly no directions can be given by this Court in the present petition for the enforcement of the same very award. f

In these circumstances; the present petition cannot sustain and the same is accordingly dismissed only on the limited ground that due to the award being under challenge before this Court in W.P.(C) No.766711999 filed by the respondent no.2. The petitioner, however, is granted liberty to seek the enforcement of [he award, in the event of the dismissal of said writ petition bearing W.P.(C) No. 76671L999.
CM No.4054/201.0 is also dismissed.
