14. Defamation has been defined as a false statement which lras tlre tendency to disparage the good nerme or reputation of anotlrer person. strictly speaking, in terms of the statute, as per section 4gg lrrdian penal code, the offence of defamation consists of tlrree vital components whiclr can be categorised as under:-
(i) Ma l<ing or publish irrg a ny iin putation concerning any person.
(ii) Suclr irnputation must have been made by words either written or spol<en or by visible represerrtation.,:
(iii) Suclr imputation must [;e nrade with the intention to cause lrarm or witlr tlre l<nowledge or lraving reasons to believe tlrat it will harm the reputation of tlre person concerrred.
15. Petitioners contend that apart from tlre reporter, the editor, printer and publisher would be liable if a scandalous publication relates to a newspaper and additiorrally would urge that if a newspaper trutlrfully reports a news itent, pertaining to a fact whiclr is of public interest, nobody can be prosecuted for the offence of defamation
16. The, complainant alleges that'the news items are per se defamatory and that all accused would be liable. Il. A fair reporting pertaining to a matter of public Concern, without insinuations and innuendos i.e. a news itenr containirrg statements of true facts is not actionable for the offerrce of criminal defamation.

The FIR was made public by the police along with a press release.

The question arose whether tlre members of Editorial Board could be prosecuted for defamatory article. Adverting to. Section 7, the Supreme Court held tlrat:- "7. The term 'editor' is defined irr the Act to trean a person wlro controls the selection of the matter that is publislred in a newspaper. Wlrere there is mentioned an editor is a person who is responsible for selection of the material. Sectiorr 7 raises the presunrption in respect of such a person. The name of that person has to be printed on tlre copy of tlre newspaper and in the present case. tlre name of Madane admittedly was printed as the Editor of the Maharashtra in the copy of tlre lvlaharashtra. wlriclr contained tlie defanratory article. The decla ration in Form I which has been produced before us shows tlre naffle of M ada ne not on ly as tlre printer a nd publisher but also as tlre editor. ln our opinion tlre presumption wili attaclr to Madane as lraving selected tlre material for publication in the newspaper. lt may not be out of place to note tlrat Madane admitted tlrat he had written this article. ln the. circunrstances not only the presumption cannot be drawn agai'nsl: the others who had Crl.
