CA 2063/2011has been filed for recalling and setting aside of the order dated 14th September, 2011 by which this Court appointed a
Provisional Liquidator for the respondent-company. It has also been prayed that the office premises of the respondent-company be immediately de-sealed.
2011:DHC:9099 In the present application, it has been averred that the disputes between the petitioner and the respondent have amicably been resolved by way of an out of Court settlement under which the petitioner has received payment of~ 75,000/-.
Mr. Sarad Singhania, learned counsel for petitioner who IS personally present in Court confirms that the matter has been amicably resolved between the parties. He has also handed over in Court an application for withdrawal ofthe present proceedings. The said application is taken on record and Registry is directed to number the same.
Keeping in view the averments in CA 2063/2011 as well as the fresh application filed by the petitioner, the order dated 14th September, 2011 is recalled and the present petition is dismissed as withdrawn, subject to payment of costs of~ 15,000/- by the respondent to Official Liquidator.
Upon receipt ofthe aforesaid costs, the Official Liquidator is directed to de- seal the premises in question.
With the aforesaid observations, the present petition and applications stand disposed of. Next date ofhearing stands cancelled.
