HON'BLE MR. JUSTICE MANMOHAN
14.10.2011 On a perusal of the papers, it transpires that the present petition has been. filed under Section 446 of the Companies Act, 1956 for recovery ofRs. 17,429/- solely on the basis of an entry in the balance sheet of the petitioner company. No document has been placed on record to show execution of any transaction between the parties and as to on what account the said amount is due and payable by the respondent to the petitioner.
Keeping in view the meager amount of recovery, the lack of corroboration as well as the fact that the respondent-company is unrepresented, in all probability the Official Liquidator would spend
2011:DHC:8295 more money on recovery and execution proceedings. Accordingly, \ 2...--- the present application is dismissed.
