JUDGMENT

1. Allowed, subject to all just exceptions. W.P.(C) 15543/2024 & CM APPL. 65270/2024

2. This petition has been filed by the petitioner challenging Order No.1 47014/04/2024/ESTABLISHMENT dated 11.09.2024 issued by the respondent no.2, insofar as it transfers the petitioner to the 6th Battalion, Chhapra, Bihar.

3. The petitioner, inter alia, states that he is undergoing treatment for various ailments and has made a representation to put his transfer in abeyance.

4. Though the petitioner claims that the respondents have failed to W.P.(C) 15543/2024 grant an interview to the petitioner or to decide on his representation, the learned counsel for the respondents, who appears on advance notice, submits that an interview has been granted to the petitioner.

5. Be that as it may, we are of the opinion that the respondents should consider the contents of the present petition as a representation of the petitioner and decide the same within a period of two weeks from today. In case the petitioner is aggrieved by the decision so taken, it shall be open to the petitioner to challenge the same in accordance with law.

6. We, however, clarify that we have not expressed any opinion on the merits of the claim of the petitioner in the present petition. We further clarify that we have not granted any interim order against the transfer order of the petitioner.

7. With the above observation, the present petition and the application are disposed of.
