JUDGMENT
1. The present petition has been filed by petitioner seeking initiation of contempt against Registrar of Cooperative Societies on the premise that there is violation of order dated 08.08.2024 passed by this Court.
2. As per above order dated 08.08.2024 passed in W.P.(C) 14931/2023, the writ petition was disposed of with the consent of both the parties and RCS was directed to decide the petition under Section 70 of the Delhi Co-operative Societies Act, 2003 (in short ‘DCS Act’) as well as the execution within a period of eight weeks.
3. Learned counsel for respondents submit that there is already due compliance in this regard and the petition has been disposed of vide order dated 07.10.2024.
4. A soft copy has been shown to the learned counsel for the petitioner CONT.CAS(C) 1773/2024 2 during the course of the arguments and it is also undertaken that such copy would be transmitted through e-mail and a hard copy, thereof, shall also be supplied to learned counsel for the petitioner during course of the day.
5. It is noticed that the petitioner had sought direction for expeditious disposal of his petition under Section 70 of DCS Act as well as the Execution Petition and as per the above said order dated 07.10.2024 passed by Deputy been referred to arbitration under Section 71 of DCS Act, 2003. The claimant has also been directed to deposit Rs. 5,000/- towards arbitration fee and deposit the receipt of the same in arbitration branch within a period of 15 days of the receipt of this order, failing which, the claim shall be deemed to have been dismissed.
6. In view of the above fact, the grievance seems to be misplaced.
7. Quite possibly, on account of some delay in communication, the petitioner is, somehow, unaware of the fact that his petition under Section 70 of DCS Act had already been admitted and disposed of on 07.10.2024.
8. Be that as it may, in view of the above said fact that the petition has already been disposed of, the contempt is not maintainable.
9. The petition stands disposed of.
10. However, the petitioner is also permitted to take steps for deposit of arbitration fee within 15 days from today.
