1. Petitioner seeks pre-ponement of the date and initiation of contempt against the respondent Collector for non compliance of the order dated 09.02.2023 passed by the learned Division Bench of this Court in W.P.(C) No. 11193/2017.

2. By virtue of the above said order, the learned Division Bench of this Court had directed the Land Acquisition Collector (South) to consider and dispose of the representation of the petitioner within six weeks of the receipt of the representation and there was also a direction to communicate such decision to the petitioner.

3. It has now been informed that the concerned LAC has already considered the representation and has come to the conclusion that the petitioner-Anu Singh is entitled to enhanced compensation.

4. Thus, the grouse and grievance of the petitioner does not seem to CONT.CAS(C) 348/2024 2 survive anymore.

5. However, learned counsel for the petitioner submits that in terms of the above said order, no amount has so far been paid to the petitioner and, therefore, the petitioner seeks early hearing in the matter.

6. This Court is conscious of the fact that the petitioner has, merely, invoked contempt jurisdiction of this Court for the alleged non-compliance of the above said directions contained in order dated 09.02.2023. Admittedly, the directions have been duly complied with and, therefore, as far as the present contempt petition is concerned, actually speaking, nothing further survives in the matter.

7. Of course, the petitioner is justified in claiming that despite the fact that the representation was decided in her favour, she has yet not been paid the enhanced compensation but for that the petitioner is always at liberty to file appropriate petition or execution.

8. Learned counsel for the respondent submits that perhaps the Bank Account of LAC had been attached in relation to some execution petition but nonetheless if the petitioner makes appropriate application in this regard seeking enhanced compensation, it would be dealt with as expeditiously as possible and in accordance with law.

9. While granting the above said liberty, the present petition stands disposed of, accordingly.

10. The next date stands cancelled.
