02.05.2012 There is delay of 23 days in filing the appeal. The sequence of events as disclosed in paragraph No.3 of the application seeking condonation of delay, does not indicate as to when the file had reached ttie panel lawyer and when the appeal was drafted. Therefore, the delay occasioned does not stand sufficiently explained.
Otherwise also, appellant does not have any case on merits as in view of the decision of this Court in LA.APP. 421/2010 in Suresh
Prasad @Hari Kishan Vs. UOI&Am., rendered on 14"^ March, 2012, pertaining to acquisition of land of this very village, this appeal has to be dismissed.
