02.05.2012 On hearing learned counsels for the parties and taking into consideration the fact that the suit has already been set down for trial, the appeal is disposed of with the following agreed directions: i. The Local Commissioner appointed to record evidence has fixed the date as 14th & 15th Muy, 2012. The Local Commissioner will endeavour to conclude the recording of evidence within a maximum period of four (4) months from the said date and learned counsels for the parties assure that they will render all assistance in this behalf.

The respondents fin FAO (OS) No.28912010] willfile the accounts relating to the sales on a quarterly basis and the first statement of accounts will be filed on or before 7.7.2012 relating to the period up to 30.6.2012 iii. Needless to say that any observations made in the impugned order would not in any manner affect the merits of the controversy at the stage of final adjudication of the suit post trial.
The appeals accordingly stand disposed of. ry
