Joginder Tuli v. State

1. This petition is filed by Petitioner Ravi who is the co-accused in FIR NO. 351/2010 PS SaritaVihar. He was committed to the Court of Sessions along with co-accused by the learned Metropolitan Magistrate. The learned Addl. Sessions Judge vide order dated ll"' January, 2012 has directed the learned Metropolitan Magistrate to summon Ravinder Singh and Devender Singh @ Tape though they were kept in Column No. 12 in the charge-sheet. Ravinder Singh has challenged the order of the learned Addl. Sessions Judge vide Crl. Rev.P. 126/2012. The present petition is filed by the Petitioner stating that since the decision inthe said criminal revision petition filed by Ravinder will take considerable time, he is unnecessarily suffering in judicial custody. It is requested that the directions may be given to the Metropolitan 2012:DHC:8083 Magistrate to commit his case to the Court of Addl. Sessions Judge without awaiting outcome ofthe Crl. Rev. P. 126/2012 filed by Ravinder. The Crl. Rev.P. 126/2012 filed by Ravinder assailing the order of learned Addl. Sessions Judge dated ll"' January, 2012 has been dismissed vide separate order and that being so, the present petition has become infructuous and disposed as such. MX. MEHTA, J. MAY 08, 2012
