JUDGMENT

1. This petition has been filed by the petitioner with a limited prayer of seeking directions to the respondent to decide the representation dated 02.08.2023 by way of a reasoned order in a time bound manner. The said representation has been made by the petitioner against the findings of fact returned by the Court of Inquiry in its report dated 14.02.2023.

2. Issue notice.

3. Mr. Amit Tiwari, learned counsel, accepts notice on behalf of the respondent. He submits that the representation of the petitioner has, in fact, not been received at the Directorate General Office of the Indo-Tibetan Border Police Force (ITBP). He submits that without prejudice to the above, the representation made by the petitioner, which is annexed as Annexure P[4] to this petition, shall be duly W.P.(C) 16709/2024 considered by the Competent Authority before passing any further orders based on the Court of Inquiry.

4. The respondent is directed to consider the representation of the petitioner and pass a speaking order thereon within a period of eight weeks from today.

5. We make it clear that we have not expressed any opinion on findings of fact returned by the Court of Inquiry in its report dated 14.02.2023 or the merits of the representation of the petitioner. The same shall be considered by the respondent in accordance with law.

6. The petition is disposed of in the above terms.
