09.05.2012 This is a petition for bail in case FIR No. 684/2006, P.S. Defence Colony.
Heard the learned senior counsel for the petitioner, learned counsel for the complainant as also learned APP. Having regard to the entire factual matrix, and particularly the facts that the complainants have filed a civil suit in this court wherein a stay has been granted by this court in respect ofthe property in question and that the sale deed as also the mutation have since been rectified and the complainant is in possession of the back half portion of the said property and further, that the petitioner is in judicial custody for about 45 days by now whereas his co-accused has been admitted on bail, the petitioner deserves to be released on
~ 2012:DHC:9719 bail. Hence, he is directed to be released on bail on his furnishing personal bond lf in the sum ofRs. 20,000/- with one surety in the like amount to the satisfaction of the Trial Court, subject to his joining the investigation.
Petition stands disposed of.
