09.05.2012 This is a petition seeking anticipatory bail in case FIR No. 19/2011, P.S.
CAW, Nanakpura. The complainant present in person states that the jewellery have not so far been returned to her. On the other hand, the petitioner states that all the dowry articles have already been taken by the complainant. The
Investigating Officer present also states that no such articles have been given to the complainant by the petitioner. The petitioner is ready to pay Rs. 2 lakhs as towards the full and final settlement to the complainant, which is not accepted by the complainant.
I have heard counsel for the petitioner, complainant in person as also the
APP. Having regard to the entire factual matrix, the petitioner may give Rs. 2 lakhs to the complainant through the Investigating Officer by way of a bank draft
2012:DHC:9716 w' in the name of the complainant within two weeks, without prejudice to the rights and subject to the outcome of the main case. In that eventuality and in the event of arrest, the petitioner shall be released on bail on his furnishing personal bond in the sum ofRs. 20,000/- with one surety in the like amount to the satisfaction ofthe
Arresting Officer/Investigating Officer/SHO and subject to the condition that petitioner shall join the investigation as and when called by the Investigating
Officer.
