ORDER o/o 09.05.2012 This is a bail application filed by the petitioner for grant of anticipatory bail in F.I.R. No.138/2010, under Sections
420/468/471/120-B IPG, registered at Police Station Darya Ganj.
Learned counsel has stated that the petitioner has already deposited a sum of Rs.2 lac in terms of the order passed by this court on 21.3.2012.
The learned APP has stated that the signatures of the petitioner appended on the questioned document along with the admitted signatures of the petitioner were sent for comparison to Central
Forensic Science Laboratory (CFSL) and a report has been received to the effect that the questioned document bears the signatures of the petitioner although, the same are denied by her. It is, accordingly, contended that it is established that the petitioner has forged the documents in the instant case. It is stated that though the petitioner
2012:DHC:9113 has joined the investigation, however, she is not co-operating.
Having regard to the fact that the petitioner has already deposited a sum of Rs.2 lac and the report of CFSL has been received against the petitioner, I do not think that custodial interrogation of the petitioner is needed and, therefore, the petitioner is admitted to anticipatory bail.
Accordingly, in the event of arrest, the petitioner, Veena Dutta, be released on anticipatory bail in the aforesaid F.I.R. on her furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the lO/SHO. However, this shall be subject to the condition that (i) the petitioner shall join and co-operate with the investigation and shall furnish information with i regard to the questions which are put to her; (ii) she shall not threaten the witnesses or tamper with the evidence; (iii) she shall not leave the
National Capital Territory of Delhi without permission ofthe court; and
(iv) she shall not change her place of business. The benefit of the anticipatory bail shall be available to the petitioner for a period of six months from today, within which the petitioner shall approach the court concerned for grant of regular bail.
The bail application stands disposed of.
