JUDGMENT
1. The next date in the present contempt petition is 04.04.2025.
2. However, the above said application has been moved by petitioner seeking permission to withdraw the present contempt petition with liberty to challenge one subsequent order passed by respondent/NDMC on 12.03.2024.
3. Learned counsel for the petitioner submits that the fixation of SS Pay Scale is completely wrong and inappropriate and he would challenge the above said order by filing appropriate petition before the learned Central Administrative Tribunal (CAT)
4. It is noticed that the present contempt petition has been filed seeking initiation of contempt proceedings against NDMC for wilful CONT.CAS(C) 146/2024 2 disobedience of the directions contained in order dated 22.11.2023 passed by the learned Division Bench of this Court in W.P.(C) 5461/2010. While disposing of the above said writ petition, the respondent NDMC was also directed to give the computation/breakup of the payment made to the petitioner.
5. It is submitted by Sh. Venkatraman, learned counsel for the petitioner that since vide subsequent order dated 12.03.2024, the SS Scale has been wrongly fixed and the respondent are seeking recovery from him instead of granting any benefit, the petitioner is more interested in challenging the above said order, instead of pursing with the present contempt petition.
6. In view of the above said statement, the application is allowed and the petitioner is permitted to withdraw the present contempt petition. Liberty, as prayed, is granted.
7. The next date of 04.04.2025 is cancelled.
8. The petition stands disposed of in aforesaid terms.
