JUDGMENT
1. The grievance raised in the present writ petition is very limited.
2. Petitioner is aggrieved with the manner in which the illegal and arbitrary construction is being carried out by the concerned owner/builder at property no. 442, Shanti Marg, Vinod Nagar, Mandawali, Delhi-110092.
3. It has been claimed that there is evident violation of the Building Bye-laws as the construction has been raised upto 6th floor. A direction is, therefore, being sought to take action as per law against such illegal and unauthorized construction.
4. Learned counsel for respondent no. 1/Special Task Force DDA appears on advance notice and submits that they have already forwarded the complaint to Municipal Corporation of Delhi (East) for necessary action. W.P.(C) 17420/2024 2
5. Learned counsel for respondent no. 2/Municipal Corporation of Delhi also appears on advance notice and submits that they have already received communication in this regard and property in question has already been booked and a show-cause notice has been issued to the concerned owner/occupier of such property and they are waiting for response to such show cause notice and once reply is received, they would take further appropriate action, preferably, within eight weeks from today.
6. There is no appearance from respondent no. 4, who is stated to be owner/builder of the property in question.
7. The present writ petition is disposed of with the direction to respondent no. 2/Municipal Corporation of Delhi to take further requisite steps, preferably, within eight weeks from today.
8. Needless to say, the aforesaid disposal is without prejudice to the rights and contentions of the respective parties and in particular of the concerned owner/builder.
