JUDGMENT
1. Allowed, subject to all just exceptions.
2. Accordingly, the applications stand disposed of. CM APPL. 33896/2023 and CM APPL. 33899/2023
3. The present applications under Section 5 of the Limitation Act, 1963, read with Section 151 of Code of Civil Procedure, 1908, have been filed seeking condonation of a delay of 350 days in filing and 55 days in re-filing the review petition, respectively.
4. For the reasons stated in the application, the delay of 350 days in filing and 55 days in re-filing the review petition is condoned.
5. Accordingly, the applications stand disposed of.
REVIEW PET. 173/2023, CM APPL. 33897/2023
6. This review petition has been filed seeking a review of our Order dated 06.01.2022 passed by this Court whereby the respondents were directed to treat the writ petition as a representation of the petitioners and to extend to them the same relief as granted to SI/GD Vinod Kumar by this Court vide its Judgment dated 04.02.2019, passed in W.P.(C) No. 7577/2016 titled SI GD Vinod Kumar v. Union of India & Ors.
7. The learned counsel for the review petitioners submits that the petitioners in the main petition were not entitled to the same relief.
8. On the other hand, the learned counsel for the respondents in the review petition, that is, petitioners in the main petition, places reliance on the Order dated 26.02.2020 passed by a Co-ordinate Bench of this Court in Review Petition no. 81/2020 in W.P.(C) NO. 9094/2019 titled Mahendra Singh & Ors. v. Union of India & Ors., to submit that a similar review petition has been dismissed by this Court, and the order was upheld by the Supreme Court while dismissing the Special Leave Petition (Civil) No. 1692-1693/2021 titled Union of India & Ors. v. Mahendra Singh & Ors., vide its Order dated 03.09.2021.
9. In view of the submissions made by the learned counsel for the respondents in the review petition, we do not find any merit in the
10. present review petition. The same along with pending application is, accordingly, dismissed.
