ORDER(ORAL)
10.07.2026
JUDGMENT
1. None appears for the petitioner.
2. It is submitted by the learned Counsel appearing for the Respondent that the main Counsel for the petitioner has not been available from the last five hearings.
3. The present petition is pending since 2016.
4. It emerges from a perusal of the record that the present petition was dismissed for non-prosecution on 30.04.2024 on the grounds that the petitioner sought repeated adjournments. Thereafter, the petition was restored by a co-ordinate Bench on 12.08.2024.
5. After such restoration, there is nothing on record to indicate that O.M.P. (COMM) 306/2016 the petitioner undertook any steps to pursue the present matter. In fact, the record reveals that adjournments have been sought on 16.01.2025, 01.05.2025, 25.07.2025, 07.11.2025 and 11.03.2026 due to the nonavailability of the main counsel for the petitioner.
6. In view of the aforesaid, it seems that petitioner has lost interest in pursuing the present petition.
7. Therefore, the present petition is dismissed for non-prosecution.
