JUDGMENT

1. Allowed, subject to just exceptions.

2. The Application stands disposed of. CM(M) 147/2025 & CM Appl.4511/2025[Stay]

3. The present Petition has been filed on behalf of the Petitioner to challenge the interim order dated 20.12.2024 passed by the learned Principal District & Sessions Judge, New Delhi District, Patiala House Courts, New Delhi in an Appeal filed under Section 9 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 filed by the Respondent.

4. Learned Counsel for the parties have been briefly heard. With the consent of the parties, the matter is taken up for hearing and final disposal today. CM(M) 147/2025

5. The Respondent submits that he will be filing his Rejoinder within a period of two weeks before the learned Trial Court.

6. Learned Counsel for the parties state that they will not take any unnecessary adjournments before the learned Trial Court in the pending proceedings in Ajit Singh vs. New Delhi Municipal Council in PPA NO. 28/2024. The parties are bound down by the statement made by their Counsel today. As per the parties, the matter is now fixed for final hearing before the learned Trial Court on 24.02.2025.

7. The Petition is accordingly disposed of with these directions leaving all rights and contentions of the parties open in the matter. Pending Application also stands disposed of.
