JUDGMENT
1. The accused/applicant seeks anticipatory bail in case FIR NO. 573/2025 of PS Fatehpur Beri for offence under Section 221/132/121(1)/110/351(2)/309(4)/324(4)/249(b)/3(5) of BNS.
2. I have heard learned counsel for accused/applicant and learned APP for State assisted by Investigating Officer/SI Ravinder Singh. Date: 2026.07.13 17:03:20 +05'30'
3. Broadly speaking, prosecution case is as follows. Against an accused, namely Azam, non-bailable warrants were issued in case FIR No.479/2025 of PS Fatehpur Beri. On 15.09.2025, at about 06:00pm, on receipt of secret information, a police party was constituted to apprehend Azam. But when the police party apprehended Azam, he resisted arrest and created commotion in an effort to escape. But with joint efforts, the police team overpowered him. In the meanwhile, family members of Azam, namely his brothers Arbaz and Sahil, his sister the accused/applicant, mother Fatiah and brother Arshad’s wife, Shakeela along with a few others reached the location and all of them manhandled the police party, attacking with bricks and sticks to rescue Azam. They also bit the police personnel and damaged their vehicles. In the melee, Azam managed to escape from custody of the police party. In the incident, the police officials received multiple injuries, including bite marks and were examined at AIIMS Trauma Centre.
4. Learned counsel for accused/applicant submits that the accused/applicant is not visible in the video footage of the alleged occurrence and she is innocent. It is also submitted that the accused/applicant has not been named in the FIR.
5. Learned APP assisted by Investigating Officer/SI Ravinder Singh strongly opposes the anticipatory bail application, producing before me the video footage of the alleged occurrence. It is submitted that the present st=Delhi, Date: 2026.07.13 17:03:09 +05'30' accused/applicant wearing a pink suit is clearly visible in the video footage. It is also stated by learned APP that the present accused/applicant is absconding and proceedings against her have already been initiated under Section 84 BNSS.
6. The video footage of the alleged incident shows a group of individuals attacking the police officers in their van and Azam coming out. One of the attackers is the lady in a pink suit, alleged to be the present accused/applicant.
7. Considering the above circumstances, I do not find it a fit case to grant anticipatory bail. Therefore, the anticipatory bail application and accompanying application are dismissed.
