JUDGMENT
3. None appears on behalf of the accused/applicant. However, learned APP assisted by Investigating Officer/SI Arvind Kumar on instructions (ORAL)
1. The accused/applicant seeks regular bail in case FIR No.215/2026 of PS Nihal Vihar for offence under Section 20(b)(ii)(B) of NDPS Act.
2. Broadly speaking, allegation against the accused/applicant is the chance recovery of 1.176 kg ganja from him by a police official on patrol duty. Date: 2026.07.03 17:35:39 +05'30' BAIL APPLN. 2003/2026 pages submits in all fairness that commercial quantity of ganja is 20 kg and the allegedly recovered ganja is slightly above the small quantity, so State has no objection to this application.
4. Accordingly, this application is allowed and the accused/applicant is directed to be released on bail, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the trial court.
5. Copy of this order be sent to the concerned Jail Superintendent for being conveyed to the accused/applicant.
6. At this stage, Mr. Pranay Abhishek, counsel for accused/applicant has appeared and has been apprised of the order.
