JUDGMENT
1. The accused/applicant seeks regular bail in case FIR No. 636/2023 of Police Station Punjabi Bagh for the offence under Section 397/395/412/34 IPC read with Section 25 of Arms Act.
2. Learned counsel for accused/applicant seeks passover, awaiting the arguing counsel, but on account of pending heavy board including a large number of bail matters, passover is not possible. I have heard learned APP for State assisted by Investigating Officer/SI Jarnail Singh. Date: 2026.07.13 16:58:06 +05'30'
3. Broadly speaking, prosecution case is that three persons including the accused/applicant committed robbery by snatching money bag of the complainant. As per prosecution, the alleged snatching was done by the present accused/applicant whereas, co-accused Vinod brandished a country made pistol while accused Neeraj was driving the motorcycle.
4. Learned APP for State opposes the bail application in view of seriousness of the allegations.
5. It is not denied that the accused/applicant was arrested on 20.11.2023 and till date, even charges have not been framed. It also appears from record that one of the co-accused namely Vinod has to be produced from Azamgarh Jail and his production is quite irregular, which is leading to delay in framing of charges. It is also not denied that the secret informer had identified the accused persons as Neeraj, Vinod and Jitender, not naming the present accused/applicant, though as per the Investigating Officer, the present accused/applicant was also later identified by the secret informer.
6. Considering the above circumstances, I do not find any reason to deprive further liberty to the accused/applicant. Therefore, the bail application is allowed and accused/applicant is directed to be released on bail subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Trial Court. 7. A copy of this order be immediately transmitted to the concerned Jail Superintendent for informing the accused/applicant.
