Visage Properties Private Limited v. State of NCT of Delhi

1. Petitioner had filed a complaint and also prayed for investigation and his request for investigation has been declined by the learned Magistrate Court vide order dated 13.11.2025.

2. Feeling aggrieved, the petitioner has filed the instant Writ Petition. During course of the arguments, learned counsel for the petitioner, in all fairness, submitted that the petitioner should have rather invoked the revisional jurisdiction of the Court of Sessions.

3. Learned counsel for the petitioner therefore, prays that the present petition may be permitted to be withdrawn with liberty to him file appropriate Revision Petition before the learned Court of Sessions.

4. When the present petition was taken up by this Court on 19.03.2026, this Court had also raised a question about the maintainability of the present W.P.(CRL) 877/2026 2 petition and since the next date in the present matter is 27.10.2026, the abovesaid application has been moved seeking early hearing of the matter.

5. Mr. Rahul Tyagi, learned Additional Standing Counsel for the State has no objection to the abovesaid limited request made by the learned counsel for the petitioner.

6. Resultantly, the application seeking early hearing is allowed and the matter has been taken up today.

7. In view of the abovesaid statement made by the learned counsel for the petitioner, the present petition is disposed of as withdraw with liberty to petitioner to invoke revisional jurisdictional, if so advised.

8. All rights and contentions of the parties are reserved.

9. The next fixed date i.e. 27.10.2026 stands cancelled.
