JUDGMENT
1. The impugned order dated 22 May 2026 passed by the learned District Judge, Commercial Court-01, Rohini, Delhi[1] has allowed an application filed by the respondent as the petitioner in OMP (I) (Comm.) 51/26 under Section 9 of the Arbitration and Conciliation Act, 1996 and directed attachment of the account of the appellant without a single word by way of reasoning.
2. With consent of Counsel, therefore, the said order is quashed and set aside. The respondent’s Section 9 application is remitted to the learned Commercial Court for consideration and decision afresh. To “learned Commercial Court”, hereinafter FAO (COMM) 181/2026 expedite matters, both sides would appear before the learned Commercial Court on 7 August 2026.
3. We make it clear that we have not expressed any observation on the merits of the matter.
4. The appeal is allowed in the aforesaid terms.
