JUDGMENT

1. The present petition has been filed alleging wilful and deliberate disobedience of the order dated 20th April, 2026, passed by the Division Bench of this Court in W.P.(C) 11273/2024, titled as GS197412X Vehicle Mechanic Ajay Kumar Singh Versus Union of India and Ors.

2. As per the case of the petitioner, the respondents have now issued a speaking order dated 19th June, 2026, which ignores the directions passed by the Court, since the said speaking order is not in terms of the letter and spirit of the order dated 20th April, 2026, passed by the Division Bench.

3. Per contra, it is the case on behalf of the respondents that the speaking order was passed after considering the case of the petitioner.

4. This Court notes that vide order dated 20th April, 2026, the Division Bench had passed the following directions:

“1. Through the present Petition, filed in the year 2024, the Petitioner prays for grant of No Objection Certificate (‘NOC’) for joining the post of Instructor through Uttar Pradesh Subordinate Services Selection Commission (‘UPSSSC’). 2. The Respondents claim that the Petitioner never applied for the NOC through proper channel. Learned counsel representing the Respondents has also informed the Court that during the pendency of the present Petition, the Petitioner has resigned and has already joined the new post. 3. Keeping in view the aforesaid development, the present Petition is disposed of, while directing the Respondents to consider the Petitioner’s request for grant of NOC by treating the present Petition as his representation. 4. It is also directed that in absence of no other objection, the NOC shall be granted to the Petitioner within a period of two months.”

5. Perusal of the aforesaid order shows that directions were issued by the learned Division Bench to the respondents to consider the petitioner’s request for grant of ‘No Objection Certificate’ (“NOC”), by treating the said petition as his representation.

6. This Court takes note of the submission made by learned counsel for the respondents that the policy of the respondents does not permit grant of NOC to the petitioner for joining the post of Instructor through Uttar Pradesh Subordinate Services Selection Commission (“UPSSSC”).

7. She submits that the petitioner has already resigned from the said post and thus, no relief can be granted to the petitioner.

8. Accordingly, this Court notes that the respondents have already considered the representation of the petitioner in terms of the directions passed by the Division Bench, and have passed a speaking order with regard thereto.

9. In case, the petitioner is aggrieved by the speaking order passed by the respondents, the petitioner is at liberty to seek his remedies, in accordance with law.

10. No further orders are required to be passed in the present proceedings.

11. The present petition along with pending application, is accordingly disposed of, with the aforesaid liberty. MINI PUSHKARNA, J JULY 17, 2026
