Deepak Cables (India) Limited v. Power Grid Corporation of India Limited & Anr.

1. The present petition filed under Section 29A (5) of the Arbitration and Conciliation Act, 1996 (hereinafter referred as “the A&C Act”) seeks extension of time for completion of the arbitral proceedings and making of the Arbitral Award.

2. The disputes between the parties arose in the context of contract agreements bearing no. NESH/CSM/1208/LOA-I/2759 dated 16.12.2011 and NESH/CSM/1208/LOA-II/2760 dated 16.12.2011. Thereafter, a threemember tribunal was formed to adjudicate the disputes between the parties.

3. It is stated that the mandate of the Tribunal has been extended from time to time, and the last such extension was granted by this Court vide order dated 12.12.2025 passed by this Court in O.M.P. (MISC.) (COMM.) 1016/2025 by which the mandate of the Arbitral Tribunal was extended till 30.06.2026. It is stated that the arbitration proceedings are at the stage of final arguments; it is requested that the mandate of the Arbitral Tribunal be suitably extended.

4. The Apex Court in Rohan Builders (India) Private Limited v. Berger Paints India Limited, 2024 SCC OnLine SC 2494, has held that an application for extension of the time period for passing an arbitral award under Section 29A (4) read with Section 29A (5) is maintainable even after the expiry of the twelve-month or the extended six-month period, as the case may be.

5. Considering the circumstances, the time period for completing the arbitral proceedings and rendering the Arbitral Award, is extended till 31.07.2027.

6. The petition is allowed in the above terms.
